最近「日本をダメにした１０の裁判」という本を読んだ。一度出た判決は「判例」となって何十年もそれに沿う判決となる。
裁判官さんは先例主義の役人さんのまねをしてもらっては困る。犯罪者の思う壺ではないか？
「更生の余地が残っている」とかで罪が軽くなるのなら誰だって泣いて反省した振りをしますよ。
だからって「素人の意見を取り入れる」という裁判員制度も肯けない。
最近の裁判はとにかくおかしくなっていないか？

「先例拘束性」といいます。
恐らく、裁判員に選ばれた方々のなかで、どれだけこの「先例拘束性」という言葉を聞いていたり、理解している人がいるでしょうか？
私は、法律学科を卒業しているので、裁判における判決の「重さ」は、その事件だけではなく、将来に渡っての事件における判決に影響が及ぶことを知っています。

裁判員制度は怖い。なぜこんなに拙速なことを日本はしようとしているのかわからない。
量刑にまで関わるなんて、まして信じられない。

裁判官の判断が「０．５」。
裁判員１０人が、隠れた部屋でモニターして判断し全員一致なら「０．５」。
裁判員全員が「無罪」だとし、裁判官が「有罪」だとしたときには、「０．５」対「０．５」だが、その時は裁判官の判断を優先するくらいで丁度いいと思う。
量刑は民間人が口を挟むもべき次元の問題じゃない。

最近はマスコミが世論を動かせます。と言う事は浮動票が多い昨今は特に選挙結果を動かせると言う事です。首相とか大臣よりもテレビのキャスター・コメンテーターの方が国民の投票意識に対して影響力があると言う事です。民主主義においてこの状況は実質的な「主権在マスコミ」です。

この現状は自然の流れではなくこの状態が宜しいと考えた方が誘導したのだと診るのが自然でしょう。
そして裁判員制度、法律を熟知し人格も整った裁判官だけでなく、マスコミの影響を受けた一般人も判断に加わると言う事は、三権分立の崩壊、司法を世論（マスコミ）が支配する。という形に進むのだろう。
敗戦後は未だに軍事的・外交的に奴隷に近い扱いを受けている日本ですが更に、主権そのものを失う危機を感じています。
国会議員には権力抗争、票取り合戦だけでなく、こういった国の方向を議論してリードして欲しいものです。
